Introduction

In compliance with EU Reg. 679/2016, Tellus s.r.l. intends to inform you of the methods of collection, processing and storage of your personal data collected during the use of this website, with the intention of making you aware of your rights and how to exercise them easily, in order to respect the principles of lawfulness, correctness and transparency of processing.

Parties concerned

The interested party is you, the natural person, who provides us with the personal data being processed.

The Data Controller, in compliance with the GDPR, has designated the Data Protection Officer (DPO) who may be contacted to request explanations regarding this Policy or to exercise the rights provided by the law on personal data protection described in the following text. The data will be processed in accordance with the applicable pro tempore Italian legislation on the protection of personal data (the “National Legislation”) and EU Regulation 679/2016 – General Data Protection Regulation (“GDPR”) (hereinafter the National Legislation and the GDPR are collectively referred to as the “Applicable Legislation”), recognizes the importance of the protection of personal data and considers its protection one of the objectives of its business.

With reference to this data processing, the following information is provided (“Privacy Policy”), whose validity:

  • is intended to be applicable only to the site www.tellus.it (“Website”) while it does not apply to other websites that may be consulted through external links;
  • is to be understood as information provided in accordance with Article 13 of the GDPR to those who interact with the Website.

Personal data subject to processing

By “Personal Data” we mean any information relating to an identified or identifiable natural person with reference to an identifier such as a name, an identification number, location data, an online identifier or one or more characteristic elements of his physical, physiological, mental, economic, cultural, or social identity. The Personal Data collected by the Website are the following:

a) Navigation data

The Website information systems collect some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with the user of the Website, but by its specific nature could, through processing and association with data held by third parties, allow the user to be identified. These include, for example, IP addresses or domain names of the devices used to connect to the Website and other parameters relating to your operating system and computer environment.These data are used, for the time strictly necessary, for the sole purpose of obtaining anonymous statistical information on the use of the Website and to check its correct operation; to allow – given the architecture of the systems used – the correct provision of the various functions you requested, for security reasons and to ascertain responsibility in the event of hypothetical computer crimes against the Website or third parties and are deleted immediately after processing.

b) Data provided voluntarily by the user

The optional, explicit, and voluntary sending of electronic mail to the addresses indicated on this website, or by filling in the dedicated forms, entails the subsequent acquisition of the sender’s address, necessary in order to reply to requests, as well as any other personal data included in the message. The data may eventually be used to provide the service requested as part of the normal activities performed by Tellus. Data collection methods

Our company collects personal data about you directly from you because of your interaction with the Website. You may also provide us with your personal data when requesting information, during negotiations, the stipulation of contracts or their execution, as well as at the time of joining/paying for services, however qualified or named. Apart from the case of use of the Website or the sending of commercial requests, the collection may take place during events organized by us or by third parties, such as trade fairs or meetings. In this case, without prejudice to the provisions of Article 13 paragraph 4 of the GDPR, you will be provided with appropriate information prior to the collection of the data and the start of the processing activities.

Purpose, legal basis and mandatory or optional nature of the processing

Personal Data provided through the Website will be processed by Tellus for the following purposes:

a) purposes related to the execution of a contract to which the user is party or to the execution of pre-contractual measures taken at the user’s request (e.g.: request for contact via email or form, answers to questions, quotes, etc.).

b) purposes of research/statistical analysis on aggregate or anonymous data, without therefore being able to identify the user, aimed at measuring the functioning of the Website, measuring traffic, and assessing usability and interest.

c) purposes relating to the fulfilment of a legal obligation to which Tellus is subject.d) purposes necessary to ascertain, exercise or defend a right in court or whenever the judicial authorities exercise their judicial functions.

The legal basis for the processing of Personal Data for the purposes referred to in point a) is the provision of a service or response to a request that does not require the user’s consent under Applicable Law. The purpose referred to in point b) does not involve the processing of Personal Data, while the purposes referred to in points c) and d) are processing necessary to comply with a legal obligation to which Tellus is subject or to exercise its right of defence in court. The provision of Personal Data for the purposes listed above is optional, but failure to provide such data may make it impossible to process a request or to carry out the services offered or to fulfil contractual obligations undertaken, with consequent prejudice to the correct fulfilment of legal obligations, such as accounting, tax, and administrative obligations, etc., to which Tellus may also be subject.

Data processing methods

Your data is processed by personnel specifically appointed by the Data Controller based on their role in the company, on paper and/or on magnetic, electronic or telematic media and, in any case, using instruments that guarantee security and confidentiality. The processing of your data takes place mainly on the premises of our Company. We ensure that our service providers guarantee full compliance with the security standards required by the “GDPR”. Your data will not be transferred to non-EU countries that have not been subject to a compliant “adequacy” assessment according to the criteria of the competent authorities (“Commission”) and therefore do not guarantee sufficient levels of security in the management of the data that belong to you.

Recipients

The personal data of users who request the dispatch of informative material (answers to questions, quotes, etc.) are used solely for the purpose of providing the service requested and are communicated to third parties only in cases where this is necessary for the fulfilment of the requests (e.g. dispatch of documents or material by express courier) or where such communication is required by law or during legal proceedings.

In other terms, Personal Data may be shared, for the purposes indicated above, with:

a) persons necessary for the provision of the services requested.

b) persons authorized by Tellus to process Personal Data who are committed to confidentiality or have an appropriate legal obligation of confidentiality (e.g. employees and collaborators of Tellus);

c) public bodies or judicial authorities in the exercise of their functions when required by law or applicable regulations.

Processing related to the management of the web services of this site is handled by technical personnel of Tellus srl or by external parties specifically appointed as data processors by Tellus.

Data retention period

Unless otherwise established by Italian or Community law, which imposes a legally determined storage period, your data will be stored for the time strictly necessary for the purposes for which they are collected, in any case for a maximum period of 1 (one) year and will then be deleted from all our systems.

Your rights

  1. We inform you that you may at any time
    • access your data to obtain information about the processing (art. 15).
    • rectify inaccurate data or request the integration of incomplete data (art. 16)
    • delete data concerning you (art. 17).
    • limit the use of data in the cases referred to in Article 18.
    • request that a document be produced to you, even in digital format, containing your data for the purposes of portability (art. 20);
    • revoke your consent to the specific processing. Such revocation does not preclude the lawfulness of the processing carried out based on the consent given prior to the revocation.
    • to submit a complaint to the competent authorities.
  2. Regarding the right to oppose, we inform you that you have the right to oppose the use of your personal data in the cases referred to in Article 21, and in particular:
    • to object at any time, for reasons related to your situation, to the processing of personal data concerning you pursuant to Article 6 paragraph 1 letters e) or f) of the GDPR. In this case the Company will refrain from further processing of personal data unless there are compelling legitimate grounds for processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims;
    • if the processing is aimed at marketing activities, you may object at any time to the processing, including profiling carried out for this purpose.
  3. Regarding computerized decision-making processes, you have the right not to be subject to a decision based exclusively on automated processing, including profiling, which produces legal effects for you.
